Represented insurance carrier in coverage litigation initiated by major Roman Catholic archdiocese seeking coverage for multimillion-dollar settlement with alleged victims of clergy sexual abuse.
Representated Lawyers Professional Liability insurer in coverage disputes regarding whether allegations against law firm involved billing practices of firm or the rendering of professional services.
Successfully defended educators liability E&O insurer against action brought by general liability insurer seeking contribtion toward settlement and defense costs paid on behalf of private educational institution in action brought by student alleging wrongful discharge, breach of contract and hazing. In May 2006, the Massachusetts Appeals Court affirmed summary judgment holding that our client's "other insurance" clause contained escape and excess provisions that relieved it of any obligation to contribute toward defense and settlement costs.
Advised educators' professional liability insurer in disputes ranging from allocation of defense and indemnity costs among multiple parties to application of prior knowledge exclusion to multimillion-dollar claims by investors group following insured's declaration of insolvency, in Connecticut and Massachusetts.
Represented insurer in coverage litigation initiated by investment advisory company in dispute involving prior and pending litigation exclusion, interrelated wrongful acts of interpretation, late notice/prejudice, significant allocation issues related to uninsured parties and uninsured claims, and professional services coverage.
Advised HMO/PPO insurer, on coverage issues for dozens of claims and lawsuits tendered, arising out of doctors' claims for damages from novel concept of insured's "silent PPOs", where health care providers and claims were spread across the United States and jurisdictions had inconsistent regulatory provisions for silent PPOs and coverage issues were treated differently by jurisdiction.
