Robinson & Cole Counsel Publishes Article in the National Association of Subrogation Professionals' "Subrogator"
John E. O'Brien, Jr., of Robinson & Cole's Trial & Appellate Advocacy Practice, published an article in the Spring/Summer 2007 issue of Subrogator, a publication from the National Association of Subrogation Professionals. Entitled "Duty to Report a Fire," John's article discussed a settled arson subrogation case based on the theory that the defendant had a duty to report the fire. Click here to read the full article.

Robinson & Cole LandLaw Associate To Serve Second Year on ABA Committee
LandLaw Associate, Kirstin M. Etela recently accepted a request to serve for a second year on the ABA Section of Environment, Energy, and Resources State and Regional Environmental Cooperation Committee. She will continue as Editor and Vice-Chair of the Committee Newsletter, and will also be serving as a Regional Co-Vice-Chair reviewing and reporting on environmental issues and developments in EPA Region 2, which includes New York, New Jersey, Puerto Rico, and the United States Virgin Islands. Last year Ms. Etela was able to facilitate the committee's return to publishing two newsletters for the year and seeks to continue that trend.

Robinson & Cole LEB Attorneys Present a Labor and Employment Law Update to NECCA
On September 5, 2007, Robinson & Cole attorneys Alida Bogran-Acosta, Jeffrey L. Hirsch, Peter J. Moser, Catherine E. Reuben, and David B. Wilson will lead a workshop, "2007-2008 Labor and Employment Law Update," to members of the New England Corporate Counsel Association, Inc. (NECCA). The panel will discuss such topics as the Supreme Court's Ledbetter decision regarding the time period for bringing claims, the latest in wage and hour class action suits, "family responsibilities" discrimination, pending state and federal legislation that would impact union organizing, non-competition agreements, mandatory arbitration agreements, tax issues with respect to severance and settlement agreements, new posting and EEO reporting requirements, as well as possible trends for 2008.

On August 9, 2007, Robinson & Cole attorneys Peter J. Moser and John R. Bauer led a presentation on confidentiality agreements, how to protect trade secrets, and family responsibility discrimination at the Associated Industries of Massachusetts' (AIM) monthly "Human Resources Roundtable." AIM's HR Roundtables allow organizations' representatives to discuss current developments, pending legislation and amendments, concerns, or problems facing professionals in human resources every day.

Robinson & Cole Attorney Appointed to the Town of Belmont, Massachusetts Planning Board
Robinson & Cole LandLaw Attorney Carla M. Moynihan was recently appointed to the Planning Board of the Town of Belmont. The Planning Board addresses land use development issues that may affect the future of Belmont, Massachusetts, including re-zoning proposals, new land-use patterns, traffic concerns, and specific development proposals. The Planning Board is also responsible for holding public hearings for all proposed zoning amendments and applications filed under the Design & Site Plan Review Zoning By-Law.

John A. Poakeart, a member of the firm's LandLaw Section, has been appointed to a leadership position on the Executive Committee of the New York State Bar Association's Young Lawyers Section. Specifically, Mr. Poakeart will be a representative of the Ninth Judicial District, which covers Dutchess, Orange, Putnam, Rockland and Westchester Counties. The NYSBA is the nation's largest voluntary statewide association of lawyers.

Linda L. Morkan, Chair of R&C's Appellate Practice Group, published an article in the July 2007 issue of For the Defense, the Defense Research Institute's national monthly magazine. Entitled "Visual Rhetoric in the Appellate Brief," Linda's article focuses on techniques for making an appellate brief both visually interesting and easier for the reader to comprehend. Robinson & Cole Trial and Appellate Associate Co-chairs Panel Discussion at UConn's School of Law
On Wednesday, July 18, 2007, Jude Francois co-chaired a panel discussion at the University of Connecticut School of Law sponsored by the George W. Crawford Black Bar Association regarding the legal impact of the recent United States Supreme Court decision, Parents Involved in Cmty. Schs. v. Seattle Sch. Dist. No. 1, on diversity plans for Connecticut public schools. Approximately 75 attendees, including educators, parents, law students, attorneys and representatives from numerous organizations such as the ACLU, NAACP and ConnCAN, participated in a dynamic discussion regarding public school diversity. Jude also serves as Secretary of the George W. Crawford Black Bar Association.

R&C Trial & Appellate Advocacy Partner Steven P. Perlmutter recently published "It Could be the Lease of Your Worries: Employers May be Liable for Damages Suffered by Temporary Workers" in the May 2007 issue of New England In-House. His article reminds employers that, even though they may want to reap the financial benefits of utilizing alternative staffing arrangements (e.g. leased workers, temporary workers) instead of regular employees, they may see those savings dissipated if they are not vigilant about making sure the type of insurance they purchase covers these workers. Robinson & Cole's Boston Associates Participate in the GBLS Associates Fund Drive
The Boston associates of Robinson & Cole participated in the Greater Boston Legal Services (GBLS) 2007 Associates Fund Drive in support of the GBLS Family Law Unit. The funds raised by the associates at firms across the city, totaling over $200,000, will enhance the ability of GBLS to provide free legal assistance to victims of domestic violence. R&C achieved 100% participation among all of its associates for the third year in a row. The co-captains for the drive at R&C were Matthew J. Lawlor, Amie R. Pelletier, and Catherine N. O'Donnell.

R&C Insurance Group attorneys Steven Goldman and Wystan Ackerman have been invited to address the AIA's Law & Regulations Committee in Washington, D.C., on the subject of Louisiana Valued Policy Law litigation. The invitation resulted from an amicus brief authored by Mr. Ackerman earlier this year that was considered by the Louisiana appellate court. The Law & Regulation Committee of the AIA consists of the General Counsel of most of the major property casualty insurance companies in the United States.

Robinson & Cole Volunteers at the Greater Boston Food Bank Sorting Competition
Volunteers from Robinson & Cole, and family, participated in a "food sorting competition" at the Greater Boston Food Bank on June 20, 2007. R&C sorted more than 8200 pounds of food to be distributed to local food pantries, soup kitchens, and homeless shelters to help feed the hungry in Eastern Massachusetts. R&C LandLaw Partner speaks on Zoning Reform Legislation in Massachusetts
Brian W. Blaesser, a partner in Robinson & Cole's Land Use Group, recently spoke at a Massachusetts conference of the American Council of Engineering Companies (ACEC) regarding proposed zoning enabling act reform legislation (HB 175 and SB 151). The proposed legislation - entitled the "Livable Communities and Zoning Reform Act" - would substantially change the Commonwealth's existing zoning, planning and subdivision control statutes. Mr. Blaesser presented a critique of the proposed changes from the perspective of the real estate development industry. Mr. Blaesser is the author of the book, Discretionary Land Use Controls: Avoiding Invitations to Abuse of Discretion (Thomson-West:2006).

Robinson & Cole Labor & Employment Partner Promotes Transgender Rights
On May 15, 2007, Robinson & Cole Labor & Employment partner Catherine E. Reuben joined others at the Statehouse to educate legislators and the press about House Bill 1722, which would amend Massachusetts's anti-discrimination statute to include gender identity and expression. The legislation would also amend the state's hate-crime laws to include penalties against perpetrators of crimes who target a person because of his or her gender identity or expression. Cathy was recently quoted in Massachusetts Lawyers Weekly in an article about bar association support for the legislation.

Robinson & Cole Appellate Chair Serves As Member of Faculty at Three-Day Appellate Institute
In early May, Linda A. Morkan spent three days serving as a faculty member at the Appellate Advocacy Institute, sponsored by the Connecticut Bar Association's Appellate Advocacy Committee. The Institute takes an intensive "hands-on" approach to training lawyers on how to best construct and argue state and federal appeals, with experienced appellate practitioners and state appellate judges serving as instructors and working with the students in an interactive setting.

Bates appeared at the Land Development East Conference and Expo in Orlando, Florida, where he delivered a focus session presentation on "After Kelo: What is the Future of Eminent Domain." Two Robinson & Cole Lawyers Judge at Yale Invitational Mock Trial Tournament
R&C Trial & Appellate Group lawyers Meghana D. Shah and Adam T. Boston both participated, as judges, in the 2006 Yale Invitational Mock Trial Tournament. As judges they were responsible for scoring the competition, making evidentiary rulings and providing constructive criticism of the participants. This tournament is an annual event, and has grown to become the largest undergraduate mock trial competition – invitational, regional, and national – in the country.
