    Biography

    Laura Farach is a member of the firm's Insurance + Reinsurance Group, where she focuses her practice on first and third-party liability, auto and property insurance coverage, bad faith litigation, and general commercial litigation. Ms. Farach represents national and international insurance and corporate clients in complex actions in state and federal courts.

    Liability Insurance Coverage and Defense

    Ms. Farach has extensive experience representing insureds and insurers in first and third-party liability insurance matters involving premises liability defense, professional liability defense, products liability defense, automobile negligence matters, construction defects, condominium and homeowners’ association defense, and negligent security, among others. She has obtained very favorable judgments and settlements for her clients, even in the most challenging jurisdictions and in cases involving numerous parties with juxtaposed interests.

    Auto and Property Insurance Coverage

    Ms. Farach regularly litigates and advises clients on auto and property insurance coverage issues and allegations of bad faith and unfair claims settlement practices. Regarding property insurance matters, she handles both residential and commercial property losses including, but not limited to, sinkhole, water, wind, and fire claims, vandalism, theft, and business interruption and lost profits claims. She has won pretrial dismissal of property insurance lawsuits, including lawsuits asserting extra-contractual damages and bad faith claims such as those available under Florida’s Bad Faith Statute and Florida’s Unfair Insurance Trade Practices Act. Ms. Farach regularly works with medical experts and providers, structural engineers, forensic accountants, building consultants, and other expert witnesses, to develop the most effective litigation strategy for each case. She is also a contributor to the firm's Property Insurance Coverage Insights blog.

    Bad Faith Litigation

    Ms. Farach has extensive experience representing insurers in cases involving Florida’s Bad Faith Statute and Unfair Insurance Trade Practices Act, and the Federal Deceptive and Unfair Trade Practices Act and Unfair Claim Settlement Practices Act as related to matters of professional liability and significant liability exposures. Ms. Farach regularly defends and obtains favorable results for her insurance clients regarding allegations of bad faith in Florida courts as well as in regulatory proceedings with the Florida Department of Financial Services. She is also experienced regarding the timing and triggers related to undisputed and interim payments, as well as the procedures for proper adjustment of insurance claims. Ms. Farach has presented and published on this issue for the American Bar Association’s Torts Trial and Insurance Property Section.

    Complex Commercial Litigation

    During her tenure with Robinson+Cole, as well as with her previous U.S. News & World Report "Best Firms" law firm, Ms. Farach has advocated for her national and international corporate clients in complex litigation actions in state and federal courts nationwide. Ms. Farach has successfully represented clients in cases involving international trade disputes, securities violations, unfair and deceptive trade practices, fraud, foreign corrupt practices violations, corporate espionage, and cyber security breaches. She also has notable experience in will and trust contests and well as employment discrimination matters. Ms. Farach has represented various Fortune 500 companies and obtained favorable results for those clients.

    Ms. Farach has served as legal advisor to a U.S. Senator, and she worked on the confirmation of the first Hispanic-American Justice to the U.S. Supreme Court, Sonia Sotomayor. Additionally, Ms. Farach served as a foreign affairs liaison to a U.S. Congressman where she drafted numerous reports utilized in the passage of several Congressional bills regarding human rights issues in off-shore detention centers. She also clerked for the Honorable Gill S. Freeman, Circuit Court Judge of the Eleventh Circuit of Florida, Complex Business Litigation Division. Most recently, Ms. Farach has been involved in lobbying efforts on behalf of the insurance industry to reform Florida’s laws regarding the assignment of insurance benefits.

    Ms. Farach was a Florida-licensed insurance representative for almost 10 years and has been working with the insurance industry for almost two decades. She has taught financial literacy seminars at the University of Miami and in several schools throughout Miami-Dade and Broward counties. She was the recipient of the Ford Congressional Hispanic Leadership Institute Award and a finalist in the Goldman Sachs Global Leaders Program.

      Experience

        Liability Insurance Coverage and Defense

      • Obtained dismissal with prejudice of a litigation on behalf of a large national insurance company regarding the Non-Joinder Statute as applied to actions for declaratory relief.

      • Successfully argued in favor of summary judgment in a legal malpractice suit brought against a prestigious New York law firm and some of its attorneys, on the basis of the plaintiff’s deposition admissions that she willingly disregarded the advice of her counsel.*

      • Achieved various summary judgment motions regarding the Motor Carrier Exception to the Fair Labor Standards Act in representation of a large international shipping company involved in numerous lawsuits by former employees.*

      • Obtained very favorable settlement on behalf of contractor falsely accused by condominium association of construction defects after it was revealed that the condominium association knew the property had considerable pre-existing damage, concealed same from the contractor, and wrongfully attempted to impute all damages on the contractor. 

      • Defended multinational import/export corporation in various labor disputes involving purported wrongful termination and failure to pay overtime.*

      • Defended various condominium associations in numerous claims by homeowners regarding purported breaches of the Florida Condominium Act and the condo declarations and bylaws.*

      • Auto and Property Insurance Coverage

      • Successfully represented large national insurance carrier in contentious uninsured/underinsured motorist coverage action whereby the driver of the commercial vehicle was not listed on the commercial, the only driver in the commercial auto policy had a suspended driver’s license, and the named insured concealed that material fact on the application of insurance.

      • Obtained a very favorable settlement on behalf of a large national insurance carrier in a matter involving a stolen luxury motor vehicle per the policy’s exclusions for theft by a motor transport company, an agent of the insured, or anyone entrusted with the vehicle.

      • Regularly litigates dozens of matters on behalf of large national and international insurance carriers involving residential property claims purportedly damaged by water, wind, fire, or sinkhole activity in very challenging jurisdictions achieving the best-possible result for the carriers and fully eliminating extra-contractual liability such as bad faith.

      • Successfully argued against the enforcement of assignment of benefits on the grounds that it is illusory whereby the language of the assignment of benefits requires a vendor to perform certain services for the insured prior to payment and no services have been rendered or the services were rendered by another vendor.

      • Obtained hefty sanctions against plaintiffs and plaintiffs’ counsel for egregious misconduct during the course of litigation to include willful violations of court orders, extremely dilatory tactics, and misrepresentation of material facts by the plaintiffs.

      • Bad Faith Litigation

      • Successfully obtained dismissal of action on behalf of a large national insurance carrier on the basis of the plaintiff’s failure to comply with condition precedent to bringing bad faith action.

      • Regularly and vigorously defend and respond to civil remedy notices filed with the Florida Department of Financials Services alleging bad faith, improper claims settlement practices, and improper conduct by claims professionals on behalf of large insurance carriers.

      • Obtained numerous voluntary dismissals of counts and actions alleging bad faith and extra contractual damages against large national and international carriers under Florida’s Bad Faith
        Statute and Unfair Insurance Trade Practices Act.

      • Consistently advise clients, insurance claims professionals and other insurance professionals regarding the best practices, procedures, and standards to fully comply with bad faith and unfair trade and insurance practices law and legislation.

      • Complex Commercial Litigation

      • Represented international seafood importer and distributor in a sensitive dispute against the world's largest corporation, a Fortune 100 company, and obtained a multi-million dollar award and the successful reinstatement of the client's business relationship.*

      • Represented multinational food corporation in cross-border disputes with Latin American produce growers regarding breach of contract, fraud, and price fixing.*

      • Represented various international clients involving the enforcement of foreign judgments in the United States and the enforcement of United States judgments abroad.*

      • Represented international corporation in computer fraud and violation of privacy case in federal court regarding the Computer Fraud and Abuse Act.*

      • Defended large condominium developer in numerous breach of contract actions regarding the Florida Deceptive and Unfair Practices Act and the Interstate Land Sales & Full Disclosure Act.*

      • Defended former officers and directors of a national bank in a high-profile case brought by the federal government for purported negligence and fraud in lending during the height of the financial and mortgage crisis.*

      • Represented business partner in dispute against former business partners regarding the dissolution and redistribution of assets in a failed corporation.*

      • Represented aggrieved family members in a probate trial involving the fraudulent procurement of a will and a trust involving an elderly testator on the basis of lack of testamentary capacity, undue influence, and fraud.*
