Over the last few weeks, employers with 100 or more employees have been waiting for guidance on whether the Emergency Temporary Standard (ETS) requiring COVID-19 vaccination or weekly testing of employees, issued by the Occupational Safety and Health Administration, would remain following the numerous legal challenges that were filed. After the ETS was issued, it was immediately stayed by the federal Court of Appeals for the Fifth Circuit, but that stay was recently dissolved by the Court of Appeals for the Sixth Circuit.
