  • Overview


    Gilbert Lee advises domestic and international insurers on insurance coverage matters. He is a member of the firm’s Insurance + Reinsurance Group.

    Insurance Coverage Litigation

    Gil advises insurers on insurance coverage matters across a variety of product lines, including commercial property and casualty, pollution, environmental, professional liability, and media. He represents his clients in both state and federal courts and before arbitration panels in resolution of complex insurance coverage and bad faith disputes.

    Business Litigation

    Gil is an experienced complex commercial litigator, with a background in health care insurance fraud and construction defect matters.

    He is the author of several articles on insurance coverage litigation issues, including covered and uncovered claims, federal and state telemarketing regulations, a bad faith claim regarding Superstorm Sandy, and the application of the fraud and dishonesty exclusion in an errors and omissions policy.

      • Advised owner controlled insurance program insurer in connection with resolving construction defect claim concerning multi-unit condominium development in South Carolina.

      • Provides coverage advice to the contractor controlled insurance program carrier for a Washington state construction project in connection with multi-million dollar property damage claims.

      • Counseled domestic and international excess insurers in connection with multiple cases filed in state and federal courts arising out of a 2014 chemical spill into the Elk River in West Virginia.

      • Provides coverage advice to primary and excess insurers of global manufacturer of PVC and CPVC pipes in connection with dozens of complex product liability and construction defect claims throughout the U.S. and Canada.

      • Represents primary and excess insurance companies in connection with claims made under pollution and general liability policies involving MTBE, a gasoline additive. 

      • Provided coverage advice to insurance company in resolving multi-million dollar first-party pollution clean-up claims arising out of Superstorm Sandy.

      • Successfully represented insurance company in bad-faith coverage dispute filed in New York state court concerning whether plaintiff was entitled to additional insured coverage per the underlying maintenance contract. *

      • Represented dental professional liability carrier in declaratory judgment action against a nationwide chain of dental clinics servicing low income children. After years of hard fought litigation, the insurer and Bankruptcy Trustee reached an agreement on a complex mechanism to settle all claims of excessive and/or unnecessary dental procedures in exchange for $39 million, which was approved by the U.S. Bankruptcy Court for the Middle District of Tennessee. *
