    Biography

    Katherine M. Katchen represents clients in complex commercial litigation matters, particularly in the area of managed care and insurance. Her practice is focused on health insurers, managed care companies, and insurers and third-party administrators in state and federal actions around the country. Kate is a counsel in the firm’s Managed Care + Employee Benefit Litigation group.

    Kate has more than 20 years of litigation experience, handling matters brought by health care providers, professional medical societies and subscribers alleging a range of legal actions centered on legal theories, including: RICO conspiracy; ERISA violations; bad faith; contract and quasi-contract; tortious interference; and breach of state prompt pay. She has represented clients' needs around the country, including Pennsylvania, New Jersey, Florida, Illinois, California and Maryland.

    Prior to beginning her corporate law practice, Kate was an Attorney Advisor to the U.S. Department of Labor from 1997 to 1999. In addition, she is a long-time volunteer attorney with the Support Center for Child Advocates and a board member of the Delaware Valley Golden Retriever Rescue.

        Health Care and Insurance Industry

      • Represents and advises managed care companies, health insurers and third-party administrators in reimbursement, benefits and payment policy disputes with providers, subscribers and medical associations.

      • Works with insurer SIU/fraud units related to investigations of improper billing and referral practices, including overpayment recovery efforts. *

      • Served as counsel for Medical Assistance (Medicaid) managed care health plans in a series of actions filed by ambulance providers alleging improper reimbursement. *

      • Represented Medicare Advantage Plan in dispute with provider of risk adjustment services. *

      • Acted for an insurance company in several actions challenging the termination of an independent contractor agency agreement. *

      • Represented an insurance company in a series of class actions challenging the company’s business reorganization, and alleging claims of age discrimination, retaliation, violations of ERISA, breach of contract and breach of fiduciary duty. *

      • Other Experiences

      • Defended petroleum products marketers in various state and federal court litigation involving claims under the New Jersey Franchise Practices Act, the Petroleum Marketing Practices Act, and various theories of products liability. *

      • Litigated on behalf of a major generic pharmaceutical company in private, multi-party class action litigation involving an alleged “reverse payment” settlement. *

      • Represented a manufacturer of the building material-oriented strand board in nationwide direct and indirect purchaser antitrust class actions alleging a conspiracy to restrict supply and fix prices. *

      • Served as counsel for a leading Internet security company in a series of complex litigations arising from alleged breaches of various purchase agreements whereby the company acquired certain start-up Internet security/consulting firms, including disputes related to earnout provisions in the agreements. *
