    Biography

    Peter Knight is a member of the firm's Environmental, Energy + Telecommunications Group, where he focuses on litigation, defense of agency enforcement actions, and regulatory matters. He regularly assists clients with private cost recovery and complex multiparty Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) cases and class actions, as well as environmental remediation projects. He also represents a variety of coastal and maritime interests in connection with large vessel casualties, oil spills and emergency response, criminal enforcement, and counseling on U.S. Coast Guard regulatory matters.

    Environmental Litigation and Enforcement

    Peter has represented clients in complex environmental and energy litigation matters across the United States. These claims typically are brought under a variety of federal and state statutes, including CERCLA, the Clean Water Act, the Clean Air Act, and the Resource Conservation and Recovery Act. He has represented Fortune 500 companies in connection with the defense and prosecution of CERCLA cost recovery and contribution claims, including claims brought against the United States in connection with historical wartime operations. Peter's experience defending agency enforcement matters includes civil and criminal enforcement actions involving both land-based facilities and commercial shipping interests. A number of his maritime matters have involved major vessel casualties, including open water and coastal oil spills as well as container ship fires and explosions. His class action experience includes both environmental, energy and toxic tort matters, as well as consumer products and false labeling cases.

    Environmental Counseling

    Peter represents and manages the interests of large and small Potentially Responsible Parties (PRPs) at a number of Superfund sites across the country. He has both negotiated settlements and managed multiparty cases to resolution. He regularly works with clients on all manner of environmental legacy issues involving indemnity claims, historical liabilities, and remediation obligations. Peter also has advised companies on developing and implementing corporate compliance programs and environmental management systems. 

    Government Investigations

    Peter represents companies and individuals in a variety of government investigations. While most of these matters involve state and federal investigations of environmental and energy matters, he has also managed investigations headed by the Securities and Exchange Commission, the Coast Guard, the Commodity Futures Trading Commission, and the Financial Industry Regulatory Authority. In many of these cases, which have spanned jurisdictions across the country, he typically works with the Environmental Crimes Section of the Department of Justice. Many of Peter's maritime matters have involved Coast Guard investigations and U.S. prosecution of claimed oil dumping by commercial shipping companies.

    Pro Bono

    Peter is the firm’s pro bono partner, a role which involves coordinating the firm’s pro bono initiatives, expanding the firm’s network of pro bono clients, and matching Robinson+Cole lawyers with pro bono opportunities. His own pro bono efforts focus on representing children in neglect and abuse cases through the firm’s long-standing relationship with Lawyers for Children America. Based on his many years of service to LFCA, the Connecticut Bar Association honored him with its Anthony V. DeMayo Pro Bono Award in 2016. Peter is also part of a team of firm attorneys involved in a pro bono project to combat poaching and illegal wildlife trafficking in Namibia, Myanmar, and Laos by strengthening the country’s legislative framework.


    Peter has written and presented on a number of topics related to environmental enforcement, environmental regulation of commercial shipping, environmental disclosures, and climate change litigation. Prior to joining the firm, he practiced in the environmental and utilities group at Dewey & LeBoeuf.

      Experience

        Environmental Litigation

      • Represented transportation company in defense of an environmental class action jury trial in Massachusetts state court, one of the very few class action trials resulting from an environmental incident and, to our knowledge, the first environmental class action ever tried in Massachusetts. The case involved claims for property damage resulting from an oil spill in Buzzards Bay in 2003. The class was made up of approximately 1,000 residents from the Town of Mattapoisett who alleged their shoreline property was oiled as a result of the spill. The 2010 trial, which lasted two weeks, addressed the claims of eight individual class members. The jury ultimately awarded a very favorable result for the client. The results of these initial cases provided the parties with a basis to resolve the remaining claims.

      • Represented nuclear fuel manufacturer in Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) cost recovery claim against the United States. The facility was contaminated with highly enriched uranium as a result of contract work performed for the U.S. Navy in connection with the development of the nuclear submarine program. Our client recovered a substantial portion of its multi-million dollar site remediation costs from the Government. The cleanup was conducted under the auspices of the Nuclear Regulatory Commission.

      • Represented former nuclear fuel manufacturer based in Illinois in multiparty CERCLA cost recovery action brought by current facility owner against former operators and arrangers, including the United States. Current owner conducted multimillion-dollar site remediation and site closure to address a legacy of radiological contamination.

      • Evaluated potential litigation against upgradient manufacturing facility in connection with complex sediment site in Bridgeport, Connecticut.

      • Represented gasoline manufacturer in defense of claims brought be the State of Maryland in connection with MTBE contamination in groundwater. Achieved early dismissal of all claims based on history of importing product into the State.

      • Represent minerals manufacturer and mining operation in connection with the remediation of legacy mercury and PCB contamination. The facility was originally owned and operated by the United States, and specialty metals mined there were used to support war-time operations during World War II and the Korean Conflict. In addition to providing support on completing environmental remedial obligations, Robinson & Cole is representing the company in its cost recovery claim against the Government.

        • Environmental Enforcement

      • Represented multi-unit residential property manager in resolving an expansive Toxic Substances Control Act (TSCA) enforcement action brought by the U.S. Environmental Protection Agency (EPA) involving mandatory lead disclosures to tenants and maintenance work performed under the Renovation, Repair and Painting Rule.

      • Represent former facility operator in connection with legacy PCB issues at a manufacturing facility in Muncie, IN.  The Indiana Department of Environmental Management issued a Resource Conservation and Recovery Act (RCRA) order to former and current operators.

      • Represented nuclear fuel manufacturer at the Colorado School of Mines Research Institute site. Negotiated a favorable settlement with the State of Colorado to resolve claims brought against operators and arrangers to recover its costs at the former nuclear fuel research facility.

      • Represent former facility operator in connection with legacy solvent contamination in the form of a groundwater plume at a facility in Chico, CA.  The facility is subject to an order by the California Department of Toxic Substance Control.

      • Represented former facility operator in connection with the North Penn Area 5 Superfund site. Successfully established that the client's historical facility operations did not contribute to the groundwater plume that is the subject of the EPA action.

      • Advise former facility operator in connection with Clean Air Act issues associated with criminal enforcement case brought by the United States and EPA against current facility owner. Plea negotiations dovetailed with the facility’s acquisition and resulted in a negotiated resolution that allowed the transaction to be completed.

        • Maritime

      • Represent shipper of cargo on the MSC Flaminia, which experienced a major casualty in transit to Europe in 2012 resulting in crewmember deaths, lost cargo, and extensive vessel damage totaling over $200MM.  All claims have were consolidated in the Southern District of New York. After two separate liability phases involving six weeks of trial, the district court entered a finding of no liability for our client.

      • Represented tug and barge operator in connection with vessel explosion off of Staten Island. The EPA brought a claim against the operator under the Clean Water Act (CWA) due to resulting oil contamination. Our defense challenged the agency’s interpretation of “point source” under the CWA.

      • Represented commercial shipping company in the development and implementation of an environmental management system.  The EMS was a condition of the company’s probation arising out alleged criminal violations of the Act to Prevent Pollution from Ships, which at the time resulted in the largest environmental criminal penalty in Massachusetts.  The client successfully completed its probation period without further government action.

        • Consumer Class Action Defense

      • Represented tea company in connection with consumer class action claims in California federal court.  The class representative brought claims alleging misleading packaging promoting health benefits of tea products.  The case settled after a series of successful dispositive motions.

        On September 8, Finland became the fifty-second country to sign on to the International Maritime Organization (IMO) International Convention for the Control and Management of Ships’ Ballast Water and Sediments, pushing the Convention over the 35 percent threshold required for ratification and starting the yearlong countdown on its entry into force on September 8, 2017. The approaching deadline heightens concerns among the international shipping community over the uncertain state of ballast water management in the U.S.

        In the context of the Deepwater Horizon oil spill, Mr. Knight and Mr. Judd discuss how a fast and fair claims process in mass-casualty and toxic-tort litigation can avoid costly and drawn-out tort litigation. After the Deepwater Horizon spill, both British Petroleum (BP) and the Plaintiffs' Steering Committee quickly established a claims process, resulting in BP making thousands of payments that totaled billions of dollars. Even though BP voluntarily launched the claims process, the company now disputes its implementation. Although the Deepwater Horizon claims process is an extreme case, it provides important lessons for parties managing claims after any mass casualty.         Pro Bono Chair Peter Knight was among the panelists who discussed the Connecticut COVID-19 Small Business Virtual Legal Clinic, spearheaded by Robinson+Cole and the Connecticut Bar Association (CBA), during the webinar “Lawyers Lending a Hand in Recovery,” presented as part of the Commission on Women, Children, Seniors, Equity and Opportunity (CWCSEO) Small Business Matters Series on June 12, 2020. Lightly moderated by CWCSEO Executive Director, Stephen Hernandez, the video series focuses on small businesses as the engine of growth in Connecticut. In addition to Peter, panelists included the CBA's President, President-elect, Vice President and Immediate Past President: Ndidi N. Moses, Amy Lin Meyerson, Cecil J. Thomas, and Jonathan Shapiro, along with Marie Caroline Bertrand of DayPitney and Ginny Kim, Managing Counsel of Raytheon Technologies. During the episode, the panelists talked about how the clinic was created, the disproportionate COVID-19 impact on the minority community, and the fact that small businesses, in particular, were hard hit.         Environmental, Energy + Telecommunications lawyer Peter R. Knight spoke on “Advances in Climate Change Litigation” in an American Bar Association (ABA) Roundtable on November 20, 2019. The discussion was presented by the ABA Section of Litigation’s Environmental & Energy Litigation Committee. Peter was joined in the presentation by Chris Kilian, Director of Strategic Litigation for the Conservation Law Foundation. While cases seeking to hold large-scale emitters of greenhouse gases directly responsible for their emissions make their way through the appellate courts, a number of indirect climate cases continue to advance through the trial courts. Cases involving claims against large waterfront terminal owners alleging failure to address climate impacts at their facilities, and claims against major greenhouse gas emitters alleging failure to adequately disclose climate impacts in their public disclosures, may signify more practical trends in climate litigation.

        Sponsored by the American Bar Association (ABA) Section of State and Local Government Law's International Law Committee, the ABA Section of International Law's Anti-Corruption Committee, and the ABA Section of Environment, Energy, and Resources' International Environmental and Resources Law Committee and Endangered Species Committee, the webcast covered the current state of wildlife poaching in Namibia, legislative reforms to improve enforcement, and next steps to address the organized criminal syndicates who foster the global wildlife products trade. The legislative reform project was undertaken in 2016–17, with contribution from the ABA State and Local Government Law Section, bringing together an international research team from the U.S., the U.K., and Namibia. Peter and Megan oversaw the team in the United States researching legislative options for bolstering enforcement efforts.

        A team of lawyers from Robinson+Cole's Hartford, Stamford, and Miami offices hosted a complimentary screening of the recently released Netflix original documentary The Ivory Game. Produced by Terra Mater Film Studios and Vulcan Productions, the film describes the ivory trade and poaching of elephants in Africa. The screening was preceded by a discussion of the team's pro bono project for the Legal Assistance Centre in Namibia. The team is working with lawyers from the ABA Section of State and Local Government Law and DLA Piper in evaluating Namibia's legislative framework for wildlife crimes and in recommending legislative changes to increase effective prosecution and adjudication of wildlife crimes. Click here for a photo from the event.

        The event featured key stakeholders from the closely watched Arizona v. City of Tucson case. In this case, the Ninth Circuit Court of Appeals addressed the level of deference afforded to a trial court when reviewing a consent decree negotiated by a state agency as opposed to the EPA. The issue is critically important to potentially responsible parties (PRPs) attempting to resolve their liability at a state-led remediation site, particularly early in the case. The roundtable, which Mr. Knight moderated, included lead attorneys for the State of Arizona, the group of settling PRPs, and the nonsettling parties who challenged the de minimis settlements.

While OSHA does not have its own combustible dust standard, the Administration has said it will rely on the General Duty Clause and National Fire Protection Association (NFPA) standards for enforcement. Guidelines to prepare for and handle OSHA inspections are in some cases universal, but when combustible dust may be a factor, there are some unique considerations for employers to be mindful of. "While no OSHA standard directly addresses combustible dust, this has not hindered OSHA enforcement. Instead, OSHA has relied on the General Duty Clause and reference to the National Fire Protection Association (NFPA) standards when citing employers for combustible dust hazards." Under NFPA 652 facilities were required to complete an initial dust hazard analysis by September 7, 2020. Schaefer authored the article “Breaking the chain of “substantial continuity” — Tenth Circuit clarifies test for repeat OSHA violations” published in ISHN (Industrial Safety & Hygiene News) on February 10, 2021. The Tenth Circuit Court of Appeals in Sec’y of Labor v. Wynnewood Refining Co. recently evaluated the applicability of the substantial continuity test in connection with an OSHA citation that included several repeat violations. The article offers background on the important role that repeat violations play in OSHA citations, how the substantial continuity test has been applied in determining whether a current company should be held liable for repeat citations based on citations from a prior company, and how the Tenth Circuit addressed that question in Wynnewood Refining. Knight were among the presenters that participated in a webcast on "Preventing Wildlife Crimes in Namibia: An International Approach to Legislative Reform" on October 23, 2018. Sponsored by the American Bar Association (ABA) Section of State and Local Government Law's International Law Committee, the ABA Section of International Law's Anti-Corruption Committee, and the ABA Section of Environment, Energy, and Resources' International Environmental and Resources Law Committee and Endangered Species Committee, the webcast covered the current state of wildlife poaching in Namibia, legislative reforms to improve enforcement, and next steps to address the organized criminal syndicates who foster the global wildlife products trade. The legislative reform project was undertaken in 2016–17, with contribution from the ABA State and Local Government Law Section, bringing together an international research team from the U.S., the U.K., and Namibia. Peter and Megan oversaw the team in the United States researching legislative options for bolstering enforcement efforts.

          Members of the Environmental, Energy + Telecommunications Group participated in a community service project for Riverfront Recapture in Hartford on May 31, 2018. The group of volunteers, Emily C. Deans, Brian C. Freeman, Peter R. Knight, Earl W. Phillips Jr., and Emilee Mooney Scott, spent the afternoon working together with Riverfront Recapture staff to weed and mulch planting beds and prune trees on the walkway north of Mortensen Riverfront Plaza. Volunteers also received a short history of the area focusing on Riverfront Recapture’s efforts to reconnect the city to its prized waterfront, which was severed by dikes, I-91, and other artificial barriers in the last century. The service project is part of an effort by the Environmental, Energy + Telecommunications Group to participate in environmentally focused activities that serve the community. View photos.

          Peter Knight and Megan Baroni Conduct ABA Roundtable on CERCLA Consent Decrees

          Environmental partners Peter R. Knight and Megan E. Baroni hosted a roundtable discussion on CERCLA consent decrees on February 17, 2016. Sponsored by the ABA's Environmental Litigation Committee, the event featured key stakeholders from the closely watched Arizona v. City of Tucson case. In this case, the Ninth Circuit Court of Appeals addressed the level of deference afforded to a trial court when reviewing a consent decree negotiated by a state agency as opposed to the EPA. The issue is critically important to potentially responsible parties (PRPs) attempting to resolve their liability at a state-led remediation site, particularly early in the case. The roundtable, which Mr. Knight moderated, included lead attorneys for the State of Arizona, the group of settling PRPs, and the nonsettling parties who challenged the de minimis settlements.

          Environmental Lawyers Publish Article on Lessons from Deepwater Horizon

          Hartford environmental lawyers Peter R. Knight and Alexander W. Judd wrote the article "Mass Tort Claims Administration and Handling: Lessons from Deepwater Horizon," which appeared in the Winter 2015 issue of Environmental Litigation, a publication of the American Bar Association. In the context of the Deepwater Horizon oil spill, Mr. Knight and Mr. Judd discuss how a fast and fair claims process in mass-casualty and toxic-tort litigation can avoid costly and drawn-out tort litigation. After the Deepwater Horizon spill, both British Petroleum (BP) and the Plaintiffs' Steering Committee quickly established a claims process, resulting in BP making thousands of payments that totaled billions of dollars. Even though BP voluntarily launched the claims process, the company now disputes its implementation. Although the Deepwater Horizon claims process is an extreme case, it provides important lessons for parties managing claims after any mass casualty.           Peter R. Knight, an environmental litigation lawyer, recently co-chaired a panel on developments in US law at the 2013 Oceans Conference in Hangzhou, China, outside of Shanghai. The conference included over 200 maritime industry professionals from China and around the world. Mr. Knight gave a presentation on US enforcement efforts in connection with Coast Guard environmental regulations. He was also among a group of presenters invited to Zhoushan, a port city south of Shanghai that was recently granted status as an economic open zone, where he spoke with municipal and industry leaders concerning environmental regulation of the shipping industry in the United States.

Knight participated in a panel discussion hosted by the Boston Bar Association to discuss their experiences in connection with one of the only environmental class actions to ever go to trial. They were joined by plaintiffs’ counsel and plaintiffs’ damages expert. The program, “Litigating Environmental Property Damage Claims on a Class Action Basis,” focused on the challenges of establishing and quantifying property damage claims on a class-wide basis. The case, DeLeo et al. v. Bouchard Transportation Co., was tried to a jury in Plymouth, Massachusetts, in April 2010.

          The project is in partnership with DLA Piper, the United Kingdom’s Royal Foundation, and the ABA Section of State and Local Government Law. An international team of lawyers from Robinson+Cole and DLA Piper are working in three phases to (1) analyze Namibia's legislative framework regarding its poaching laws, (2) provide recommendations for legislative reform, and (3) assist with implementing recommended changes adopted by the government.

          Consisting of land use and environmental lawyers from Robinson+Cole’s Hartford, Stamford, and Miami offices, the team includes Peter R. Knight, the firm’s pro bono partner; Sorell E. Negro; Megan E. Baroni; Kelsey A. Cross; Emily C. Deans; and Diana E. Neeves.

          Robinson+Cole's commitment to providing pro bono services is a long-standing tradition, and recently three lawyers were honored for their work on pro bono cases. Peter A. Dagostine and Susan N. Masters were recognized by the Pro Bono Partnership as Volunteers of the Year for 2015 at a reception on April 26, 2016, and Peter R. Knight was one of the Connecticut Bar Association's Anthony V. DeMayo Pro Bono Award recipients and honored at the CBA's annual awards celebration on April 14, 2016.  

          In 2015, Robinson+Cole's lawyer and nonlawyer timekeepers contributed over 9,000 billable hours, with a value of over $3 million, toward pro bono work.

The CFPA is a 501(c)3 nonprofit organization dedicated to connecting people to Connecticut's forests, parks, walking trails, and open spaces in order to preserve the land for future generations. With a staff of experienced conservation professionals and a board of directors dedicated to its mission and values, CFPA delivers programs on environmental education, land conservation, and public policy and hosts events along the state's 825 miles of blue-blazed hiking trails.
