Our Energy Group has decades of collective knowledge and experience in all stages of energy project development. Our lawyers, lobbyists, and analysts are regularly called upon for guidance in the earliest planning phases of projects, long before the ground is broken. Because the unique circumstances of each project calls for a specific approach to optimize success, we help clients find the most efficient solutions.

Our Services

We represent energy project developers, property and project owners, lenders, design professionals, and engineering, procurement, and construction (EPC) contractors on all aspects of energy-related project procurement and delivery for traditional, alternative, and renewable energy projects. For instance, we assist energy clients and project developers with securing facility siting and permit approvals for projects and help them obtain other regulatory approvals for the development of renewable and more traditional electric generating facilities. We also provide these services:

  • help clients obtain long-term electricity purchase agreements and obtain necessary approvals for facility construction and operation
  • negotiate interconnection agreements
  • draft and negotiate EPC contracts
  • counsel clients on locating and accessing federal, state, and local funding sources for renewable energy and distributed generation projects
  • advise clients on opportunities to earn income from projects
  • help clients secure renewable attribute accreditation for projects

Our lawyers have represented clients in connection with a host of energy development projects, including the permitting and construction of traditional and renewable power plants, the permitting and construction of power transmission and distribution facilities, and modifications to and the decommissioning of a nuclear power station. Our team also has significant experience in representing an array of participants in disputes arising from energy projects, including administrative appeals of state agency approvals, disputes related to ownership of renewable energy credits and claims for defective design and construction, delays and inefficiencies, and disputed extra work.

    • Experience
      • Represented client in successful permitting of numerous high-voltage transmission line projects.

      • Represented client in connection with the development of a 96 MW power generating facility, including obtaining facility siting approval and the method and manner of the construction permit, obtaining and negotiating necessary property rights, and negotiating the interconnection agreement. 

         

      • Represented developer of a 650 MW natural gas-fired combined-cycle power plant in regulatory and administrative proceedings to obtain facility siting approval and related environmental permits and approvals.

      • Represented client in the development and permitting of a 30 MW on-site co-generation facility used to provide power to its existing paper products manufacturing facility. Assisted with local and state permits and approvals.

      • Represented client in the development of largest fuel cell facility in the United States, including representation in the regulatory proceeding to obtain a long-term contract and approval for the siting of the facility. 

      • Represented clients in the development of several 20+ MW solar generating facility, including obtaining facility siting approval from and representation in a regulatory proceeding to obtain a long-term power purchase contract.

      • Represented client in the permitting and development of high-pressure natural gas fuel cell-generating facilities, including obtaining facility siting and related environmental permits and approvals and representation in regulatory proceedings to obtain long-term power purchase contracts for the projects.

      • Represented client in the development of a 5 MW solar-generating facility, including obtaining facility siting approval from and representation in a regulatory proceeding to obtain a long-term power purchase contract. 

      • Represented clients in the development of a several small scale (<2MW) solar-generating facilities, including obtaining facility siting approval and related environmental permits, negotiating long-term power purchase contracts and interconnection agreements.

      • Represented chemical company in the development of a behind-the-meter solar project, including developing requests for proposals and accompanying power purchase agreement and negotiating power purchase agreements. 

      • Represented aerospace company in the development of a behind-the-meter wind project, including developing and negotiating the power purchase agreement. 

      • Represented private university in the development of a behind-the-meter solar project, including developing and negotiating power purchase agreement. 

      • Represented pharmaceutical company in the development of a behind-the-meter fuel cell project, including negotiating power purchase agreement.

      • Represented municipality in the development a microgrid project, including the negotiation of the power purchase and interconnection agreements.
