Robinson+Cole’s counseling and compliance practice is led by lawyers who possess a deep mastery of various laws and regulations that impact and govern your relationships with your employees. Our team is strategic and will work to understand your business, while designing innovative solutions to your employment challenge of the day. Our clients look to us to translate the law and regulations into practical advice that takes into careful consideration their business and core values. We routinely counsel companies and their managers, executives, and human resources professionals, and provide compliance assistance with federal, state, and local employment and labor laws, such as Title VII, the Americans with Disabilities Act (ADA), Age Discrimination in Employment Act (ADEA), Pregnancy Discrimination Act (PDA), and Fair Labor Standards Act (FLSA). Compliance is key to withstanding government scrutiny and preventing (while being ready for) complaints and litigation. We have extensive experience representing employers before state and federal agencies, such as the Equal Employment Opportunity Commission, Department of Labor, and National Labor Relations Board. Our clients include employers of all sizes in a range of industries, such as manufacturing, education, finance, energy, and health care.

Our Services

We provide counseling related to the following employment law areas:

  • hiring, discipline, and individual and group terminations
  • personnel policies, handbooks, offer letters, employment contracts, severance agreements, and other employment documents
  • disability laws, reasonable accommodations, and the interactive dialogue process
  • wage payment, meal/rest breaks, paid and unpaid leaves, and other wage-related requirements
  • all matters relating to compliance with anti-discrimination and anti-harassment laws, such as Title VII, the ADA, ADEA and PDA.
  • other laws impacting employers such as whistleblower protection, drug/alcohol testing, background checks, benefit continuation, anti-retaliation, leave laws, social media issues in the workplace, personnel files, and employee references

Our Team

Our team members have years of experience counseling employers with workforces across the United States regarding complex, high-risk, and sensitive employee relations and human resources issues as well as those that are more routine. Our lawyers regularly speak and give presentations on employment-related matters, such as protecting the company in the age of social media, the myriad interactions between leave laws and other laws, and workplace investigations, among other topics. 
 

    • Experience
      • Serving as outside employment counsel for a national company, advising in-house counsel and human resources professionals on all aspects of employment law including due diligence, hiring and termination issues, wage and hour compliance, risk management, and other employment-related matters.

      • Serving as outside employment counsel for private equity firms and providing advice on a variety of employment-related issues. 

      • Serving as outside employment counsel for national engineering and construction company with operations across the United States for all multistate employment matters including workplace investigations, policy design, wage and hour compliance, terminations, and all other risk management matters.

      • Ongoing representation of numerous employers in internal audits and federal and state governmental investigations related to wage and hour compliance, affirmative action compliance, and equal pay issues.

      • Counseled the Boards of Directors of various national companies regarding contentious executive transitions.

      • Managed complex workplace investigations on behalf of the Board of Directors and related committees of various organizations throughout the United States, including providing comprehensive resolution strategies.
