Our Construction practice group lawyers have the experience, skills, and background to address the unique legal, environmental, regulatory, lending, and financing challenges arising from energy and utility construction projects.

Our clients benefit from our collective experience and lessons learned litigating construction contract disputes. We apply this experience going forward when negotiating and drafting contracts to avoid similar disputes where possible and to allocate risk and best protect our clients on future projects.

Our Services

We represent owners, lenders, design professionals, and engineering, procurement, and construction (EPC) contractors on all aspects of project procurement and delivery for traditional, alternative, and renewable energy projects.

Our notable experience includes:

  • Negotiating and drafting agreements for the audit, design, implementation, and performance management of energy conservation programs
  • Representing municipalities, hospitals, manufacturers, and higher education institutions throughout the country in drafting and negotiating EPC contracts for the construction, maintenance, and operation of cogeneration plants and wastewater treatment facilities
  • Representing owners in drafting and negotiating of multilayered EPC contracts for natural gas-fired power plants, solar energy projects, and fuel cell facilities

We also represent owners and contractors in a host of claims, including the decommissioning of major nuclear power plants, the construction of natural gas-fired power plants, and the construction of underground power transmission facilities.

Our Construction practice group attorneys bring extensive experience to bear in representing an array of participants in disputes arising from energy and utility construction projects, including claims for defective design and construction, delays and inefficiencies, and disputed extra work.

State Pier Terminal in the Port of New London - New London, Connecticut

Representation of a quasi-governmental agency in reviewing and editing request for proposals for engineering services and preparing and negotiating professional services agreement between client and engineer and subaward agreement between client and end-user for project management and engineering, permitting and construction administration services. The project consisted of purchasing and installing mobile shore power equipment to support shore power infrastructure and supplementing in-place electrical infrastructure installed in connection with the State Pier Infrastructure Improvements Project at the State Pier Terminal in New London, Connecticut. The project, which is mostly funded by a grant from the United States Environmental Protection Agency, represents the next phase of delivering shore power to vessels docking at the terminal, allowing marine vessels to connect to the local electric grid to power onboard services instead of running their diesel engines, thereby reducing their diesel emissions and carbon footprints and decreasing health risks and noise pollution.

Contract for the replacement of a 1.2 MW cogeneration generator set with a 3 MW natural gas generator at the combined heat and power (CHP) plant located on the campus of Norwalk Hospital.

Negotiation of Contract for Utility Master Plan

Representation of an independent coeducational college preparatory boarding and day school in the negotiation of a contract for comprehensive professional and technical services to plan, design, and construct select utility infrastructure and energy projects as part of a utility master plan for the 500-acre campus.
