Class Action Defense

Our Class Action Defense practice group has defended dozens of class actions in a broad range of substantive areas, including insurance and financial services, data breach and privacy, product liability, heath care, environmental, employment, sales practices, and Telephone Consumer Protection Act (TCPA) cases.

We serve as lead national counsel in class action cases across the country, and have handled cases from New York to Texas, and Massachusetts to California. Each member of our team understands the urgency and complexity of class action matters, delivering on our commitment to protect your business interests.

Our Services

Through our mastery of class action law, combined with our deep understanding of our clients’ businesses and the industries in which they operate, we have developed innovative strategies for defending class actions. We have efficiently achieved strong results for our clients, including:

  • Obtaining dismissals on early dispositive motions, prior to commencement of discovery
  • Persuading plaintiffs and their counsel to settle putative class actions on an individual basis
  • Prevailing on early motions to strike class allegations
  • Defeating plaintiffs' motions for class certification
  • Negotiating and obtaining court approvals of class settlements on terms favorable to our clients

In one high-profile case, we protected our client’s interests by making new law in our nation’s highest court. Our team successfully petitioned the United States Supreme Court to grant certiorari and served as co-counsel on the merits in Standard Fire Insurance Company v. Knowles, 568 U.S. 588 (2013), in which the Court rejected a plaintiff's attempt to evade federal jurisdiction by stipulating that the amount sought would not exceed the $5 million threshold under the Class Action Fairness Act of 2005. The case was subsequently withdrawn after it returned to federal district court rather than the plaintiff’s preferred Arkansas state court venue.

Our Class Action Defense team brings the right lawyers to the table from day one, putting together team members with expertise in class action law along with others who have expertise in the relevant substantive area and industry, to skillfully develop innovative case strategies. We have significant trial experience, and we are experienced in numerous types of class action matters as well as relevant industries and substantive law.

Our team comprises attorneys collaborating throughout our firm’s diverse practice groups, including Business Litigation, Insurance + Reinsurance, Data Privacy + Cybersecurity, Health Law, and Product Liability Litigation. When it comes to insurance coverage issues, we know the ins and outs of insurance company procedures and practices. Our data breach and privacy team members stay up to date in this rapidly evolving area of law that has become a hotbed for class action filings, while our health care and managed care and employee benefits attorneys are knowledgeable of all governing statutory and regulatory requirements.

Experience


Class Actions: Loss of Use of Vehicles on Auto Insurance Claims

Defended a putative class action in the Connecticut Superior Court, Complex Litigation Docket, in which the plaintiff alleged that our client had a practice of paying no more than $25 per day for loss of use of a vehicle following an automobile accident, allegedly in violation of state statutes and regulations. After extensive briefing and two oral arguments, the court granted our motion to dismiss, ruling that the plaintiff, as a third-party claimant seeking to recover under an automobile insurance policy, lacked standing to pursue such claims. The plaintiff did not appeal.

Consumer Products/Class Actions: Nutritional Product Sales

Reached a favorable settlement for a manufacturer/distributor of nutritional products sold domestically and internationally involving the sale of ephedra to a Canadian citizen.

Class Actions: Insufficient Payment of Wage Benefits

Defended insurer in putative class action in the District of Massachusetts alleging insufficient payment of wage benefits on automobile PIP claims. The court granted our motion for judgment on the pleadings, agreeing with our client’s position regarding how the statute applied to self-employed individuals.
