Labor + Employment in Health Care

Handling labor and employment matters for hospitals, physician groups, clinical service providers, and other health care clients requires a solid understanding of the health care industry as well as broad-based knowledge of labor and employment laws.

Robinson+Cole’s Labor, Employment, Benefits, + Immigration lawyers understand health care. We advise our clients on everything from hiring, compensation, performance management, and documentation to employee discipline, and individual and group terminations. We prepare and offer guidance on policies, procedures, and best practices.

With respect to union employees, we advise and assist with collective bargaining, grievances, and arbitrations. Our group also works with clients to develop communication strategies and proactive initiatives that encourage positive employee relations, helping employers lawfully avoid unions.

We assist with cost-saving measures such as restructurings, reductions in force, and practice closings. Members of our group regularly prepare, negotiate, and recommend changes to physician employment agreements, template documents, modification agreements, and incentive compensation plans. We advise on minimizing the risks of employment claims, including discrimination, retaliation, free speech, whistleblower, and similar claims.

Our group also counsels on restrictive covenants, including the enforcement of noncompetition agreements and the protection of trade secrets, including patient lists.

Representation of individual physicians and professionals in the negotiation of employment contracts.

Physician + Provider Employment Agreements

Regular representation of hospitals and physician groups in connection with physician and mid-level provider employment agreements, including advice regarding Stark and Anti-kickback statute compliance, incentive compensation and gainsharing issues.

Outside General Counsel

Regular representation of hospitals, integrated delivery systems, nursing homes, continuing care retirement communities, physician groups, outpatient clinics and other health care providers as outside general counsel. Regularly advise these clients in matters of corporate governance, contracts, regulatory compliance, corporate compliance, risk management, policies, fundraising and tax exemption, employment, labor and litigation. Work closely with senior management and/or general counsel in transactional and day-to-day risk management and operational issues.

Firm Attorneys Host Inaugural Meeting of AWI’s New England Local Circle

Britt-Marie Cole-Johnson, Abby Warren and Natale DiNatale hosted the Inaugural Meeting of the New England Local Circle Kick Off Meeting of Association of Workplace Investigators (AWI) at the Boston office on March 21, 2019. Britt-Marie and Dinamary Horvath of Maxe Law will serve as co-conveners for the New England Local Circle, which will meet five times per year in the Boston office. Participants were offered an overview and history of AWI and the benefits of membership in the New England Local Circle, which include an online idea-sharing forum hosted in a private group on LinkedIn and referral and learning opportunities. AWI is an international professional membership association for attorneys, human resource professionals, private investigators and others who conduct, manage, or have a professional interest in workplace investigations, and has a current membership of more than 1,000 professionals. Britt-Marie serves as a member of the Board of Directors for AWI and will be a faculty member at the upcoming AWI Training Institute for Workplace Investigators in Chicago.
