The Employee Benefits and Compensation Group focuses on the legal needs of employers and fiduciaries in designing and administering their employee benefit programs. We pride ourselves on providing benefit solutions that meet the business needs of our clients while providing advice on retirement plan design and the myriad tax, ERISA, securities, accounting, and business implications for public and private employers.

Our Services 

We advise and support our clients on a wide range of tax-qualified retirement plans, including:

  • Defined contribution plans, including 401(k) plans, profit sharing plans and money purchase pension plans 
  • Defined benefit plans, including cash balance plans
  • Employee stock ownership plans (ESOPs) 
  • Multiple employer plans (MEPs)
  • Retirement plans covering unionized employees, including multiemployer and Taft-Hartley pension plans 

Our work ranges from advising on the creation and development of plan design changes, to work related to mergers and acquisitions, to representing clients before the Internal Revenue Service, the Pension Benefit Guaranty Corporation, and the Department of Labor. We regularly review agreements between plan sponsors and their vendors, including investment contracts and service agreements. We also advise our clients on fiduciary governance and structure, providing ERISA fiduciary training, assisting investment and plan administration committees, and attempting to minimize the likelihood of litigation over these issues.

In recent years, a significant portion of our practice has focused on the identification and correction of plan compliance issues and the effective utilization of governmental correction programs. Our approach is practical ensuring our clients remain compliant with regulatory requirements while making informed business decisions.
