Retirement Plan Design + Administration

Virginia’s practice addresses a broad array of issues relating to the design, drafting, and operation of qualified and nonqualified defined benefit and defined contribution plans, including 401(k), profit-sharing, multiemployer, employee stock ownership and Section 403(b) and 457(b) plans of tax-exempt organizations. She represents clients before the Internal Revenue Service, the Department of Labor, and the Pension Benefit Guaranty Corporation in connection with audits, qualification submissions, plan corrections, and other matters.

Health + Welfare Benefit Plans

Virginia has considerable experience counseling clients on a wide range of health and welfare benefits matters, including issues related to the Affordable Care Act, self-funded health arrangements, wellness and disease management programs, HIPAA privacy and security rules, COBRA administration, and various state laws and regulations governing health and welfare plan design and administration.

Governmental Plans

Virginia frequently works with state and municipal governmental clients sponsoring and administering benefit plans and programs. She advises these clients on qualified retirement plans and 457(b) plans, from generally applicable requirements to unique rules addressing vesting requirements for governmental plans, pick-up of employee contributions, purchase of service and 415(m) excess plans. Additionally, she advises clients on state statutes relating to the implementation and governance of public plans, as well as the interpretation of specific enabling statutes creating various governmental entities.

Executive Compensation + Equity Arrangements

Virginia has a broad depth of experience in designing, implementing and maintaining executive and outside-director compensation and incentive programs, including equity-based plans. She regularly provides counsel on the tax consequences of such programs, as well as assisting in structuring those arrangements to comply with ERISA, Section 409A, and Section 457(f) (for tax-exempt organizations). Virginia also advises clients regarding change in control issues involving golden parachutes. In addition to designing executive compensation programs, she assists compensation committees of public companies on compliance with Securities and Exchange Commission disclosure and reporting requirements.

Fiduciary Advice

Virginia routinely counsels boards of directors, trustees, investment committees, plan administrators, and plan fiduciaries regarding their duties and responsibilities under federal law. She counsels plan sponsors on all aspects of ERISA fiduciary compliance, including plan governance, plan expense issues, and the selection and monitoring of plan investment options.

The author of numerous articles on employee benefits matters, Virginia is also a frequent speaker at insurance, human resource, financial institution, brokerage and government plan conferences.

Weight Loss, Miracle Medications & the Workplace

BusinessWest

In the article, Virginia and Abby discuss the seemingly ubiquitous nature and acceptance of weight loss drugs now being referred to as “miracle medications” and the impact that’s having in the workplace. While New York City may have been among the first cities to codify the protection of employees from discrimination based on their weight, the federal Equal Employment Opportunity Commission has long held the position that height and weight are generally unacceptable pre-employment inquiries. In short, weight has always impacted the workplace, including workplace decisions. The authors offer valuable takeaways for employers including: fostering a positive and inclusive work environment that extends to weight, height, body shape, and appearance; establishing specific training of managers, supervisors and individuals involved in recruiting and hiring about weight and height discrimination and bias; and supporting the health and well-being of employees and their health journeys. Here’s what employers need to know about CT’s mandatory worker retirement plans

Experts Corner section of the Hartford Business Journal

The article focuses on the Connecticut Retirement Security Authority (CRSA), which was enacted by legislation in 2016. Virginia and Alisha write that the CRSA was charged with “designing and implementing a state-sponsored retirement savings program through which private-sector employees can participate if their employer does not offer a retirement savings plan.” The CSRA’s response was to create MyCTSavings, the retirement savings program that assists the more than 600,000 employees in the state who have no access to employer-sponsored retirement savings plans. The program requires both nonprofit and for-profit private-sector employers with five or more employees - each of whom has been paid more than $5,00 in the calendar year - to participate if they do not offer a qualified employer-sponsored retirement plan. View the article.

Robinson+Cole Recognized at 2026 Women, Influence & Power in Law Awards

Robinson+Cole lawyers Virginia McGarrity and Mallori Thompson and Chief Talent Officer Catherine Duke were selected for recognition at this year's Women, Influence & Power in Law (WIPL) Awards, presented by Corporate Counsel in Chicago, IL, on April 14, 2026. The Awards recognize outstanding women in the legal industry who have made a remarkable impact across multiple categories, celebrating trailblazers, advocates, and leaders whose exceptional skill, dedication, and commitment continue to advance equality in the profession. Virginia won the “Law Firm Ally of the Year” award, reflecting her ability to listen with empathy and seek understanding from different perspectives and an unwavering commitment to diversity efforts within the firm. Virginia has paired legal excellence with a deeply rooted, values-driven commitment to inclusion and equity. As chair of Robinson+Cole’s Diversity, Equity, Inclusion + Belonging Committee and leader of the firm’s Employee Benefits + Compensation practice, she models allyship that is empathetic, visible, vocal, and effective. Virginia approaches inclusion not as an initiative, but as the operating system for how the firm works—an approach reflected in R+C’s sixth consecutive Mansfield Certification Plus and recognition as a 2025 Top Inclusive Workplace. She has cultivated trusted, firmwide spaces for dialogue and learning through Town Halls that elevate voices and translate insight into action. Her mentorship of students and attorneys alike is grounded in honesty, care, and a deep understanding of professional growth. Beyond the firm, Virginia advances equity through leadership roles in community organizations dedicated to dialogue and social justice. Her impact has been recognized by numerous legal and business honors and is felt in the careers she has shaped, the communities she has strengthened, and the inclusive culture she continues to build at R+C. Mallori was named a “Next Generation of Leaders (Law Firm)” winner, which reflects her meaningful advancements in service, public or societal interest, and other initiatives she has engaged with to improve the legal profession and surrounding community. Mallori handles complex business disputes and internal investigations with rigor shaped by her experiences in appellate advocacy and prestigious federal and state judicial clerkships. She is also equally committed to developing others by supporting the next generation of lawyers through mentorship and leadership roles, including serving as one of R+C’s summer associate coordinators. Her dedication to the access of justice is reflected in her Community Justice Fellowship at Greater Hartford Legal Aid, her hands-on work addressing family violence, and determined focus on equity in the legal system. Mallori strengthens the profession through inclusive leadership as Past President of the George W. Crawford Black Bar Association and Co-Chair of the Connecticut Bar Association’s DEI Committee. Her impact has been recognized through numerous honors, including R+C’s DEI+B Award and National Black Lawyers’ Top 40 Under 40. Catherine Duke was named a finalist in the “Talent Management” category, which focuses on exceptional women who build firm culture to help grow and retain talent across their organization. Cathy’s visionary approach has reshaped how R+C recruits, develops, and retains its people. Drawing on her experience as a former practicing attorney, Cathy has built a forward-thinking Talent team focused on creating an inclusive environment where diverse professionals can grow and thrive. Under her leadership, the firm has introduced innovative initiatives spanning career development, mentoring, wellbeing, and equitable parental and caregiver benefits. Cathy has also championed data-driven programs like Stay Interviews and firmwide training on implicit bias and microaggressions, reinforcing a culture of belonging and respect. The impact of her leadership is reflected in consistent national recognition for inclusion, culture, and talent development, including six consecutive years of Mansfield Rule certifications (three consecutive years with the “Plus” annotation) and top Vault rankings. Beyond the firm, Cathy is a respected voice in the legal industry, contributing to national organizations and advisory groups focused on professional development and diversity. Together, her work exemplifies a sustained commitment to people-first leadership and the future of the legal profession.
