Robinson+Cole’s lawyers have guided educational institutions through the unique challenges associated with establishing and maintaining campus health care resources, including maintaining compliance with federal and state health care rules and regulations pertaining to establishing, operating, and/or arranging for student health centers, counseling services, clinical institutes and programs, clinical practicum affiliations, and other types of campus-based health care service arrangements.

Our Services

Our health care team understands that the needs of colleges and universities may vary depending on size and type or breadth of clinical programs as well as the specific health care needs of the campus community. Our education clients range from large, multi-program institutions with expansive internal health care services to small colleges with highly specialized health care programs and contracted health care services.

Our team has advised academic clients on regulatory and transactional matters in the following areas:

  • Negotiating health care services agreements, including professional services agreements with clinicians to staff student health services and counseling service centers, team physician agreements, telehealth service agreements, biological material transfer agreements, and on-campus flu/vaccine clinic service agreements;
  • Counseling related to the establishment of institutional HIPAA (Health Insurance Portability and Accountability Act) hybrid entity status and related HIPAA compliance programs;
  • Counseling on matters of confidentiality and privacy at the intersection of HIPAA, the Family Educational Rights and Privacy Act, and state professional and facility licensing requirements in relation to student health services, student counseling services, and clinical programs;
  • Reviewing and negotiating clinical affiliation agreements and master affiliation and service agreements with health care facilities, and counseling regarding clinical affiliation arrangements and related regulatory requirements; and
  • Counseling on general health care compliance regarding the establishment of campus clinical programs and the provision of health care services and screening clinics.

Our Team

Attorneys in our Health Law group provide multidisciplinary support at the intersection of regulatory compliance and transactional law for our education clients. Our health care attorneys work closely with other members of the Education group to provide health care compliance advice within the broader context and laws affecting higher education, including but not limited to Title IX requirements.
