Brian J. Wheelin has extensive experience litigating a variety of complex business and real estate disputes with a keen ability to achieve practical and creative solutions. For cases that cannot be resolved, he is an experienced trial lawyer who has handled over 25 jury and bench trials and arbitrations. His recent trial successes include obtaining defense verdicts of a multi-million dollar fraudulent transfer claim and defeating alleged misrepresentations surrounding the acquisition of a chemical plant. Brian also recently obtained a seven-figure judgment to recover earnout payments due relative to the sale of a technology company. Brian obtained an eight-figure settlement for a senior executive. Brian regularly argues appeals before the United States Second Circuit and state appellate courts in Connecticut and New York. He represents a range of clients, including Fortune 500 companies, lenders, developers, and Real Estate Investment Trusts. Brian has previously served as national litigation counsel for several clients.
Real Estate Litigation
Brian handles litigation which arises in the real estate context, such as loan workouts, commercial lease disputestitle insurance matters, He has obtained successful results for clients, such as defeating an injunction looking to prevent a developer from re-opening a Connecticut highway rest stop and foreclosing on a $265 million mortgage of an office building in Stamford. He regularly represents both lenders and borrowers in prominent commercial foreclosures throughout Connecticut. He recently assisted a condominium association with disbursing nearly $2 million in insurance proceeds to unit owners following a fire. Brian serves on our firm's Real Estate and Title Insurance Litigation Committee.
Commercial + Business Disputes
Brian assists clients with a broad range of commercial litigation matters including contract disputes, fraud, and intercompany claims. He has counseled clients in compliance with subpoena and governmental inquiries that, when unavoidable, have involved substantial document productions. Brian has routinely obtained dismissal of claims against his clients in advance of trial.
Litigation Management
As national litigation counsel for several clients, Brian has managed outside counsel in an effort to ensure successful, but cost-effective results. He successfully managed claims brought by over 500 plaintiffs in several courts involving a train derailment in West Virginia.
He has served as pro bono counsel and has been active on the boards of non-profit organizations in the Stamford, Connecticut area.
