Eric Del Pozo has significant experience litigating novel, complex, and high‑stakes matters at the appellate, trial, and administrative levels. Eric routinely advises clients, including businesses and public entities in regulated industries, through critical and challenging problems. A versatile advocate, he handles litigation in a variety of subjects, including disputes centering on statutory or regulatory interpretation, and those in the areas of bankruptcy, insolvency, and restructuring. 

Eric has argued more than 50 appeals in federal and state courts and has briefed more than 100 appeals. These cases have addressed precedent-setting legal questions on topics such as insurer insolvency, federal jurisdiction and preemption, agency authority and deference, business and consumer fraud, class-action standards, health care reimbursement, coastal management, free speech, religious exercise, due process, selective prosecution, and defamation per se.

Prior to entering private practice, Eric served for six years as an Assistant Solicitor General in the New York State Attorney General’s Office. He also spent several years as an appellate prosecutor for the Manhattan District Attorney’s Office, securing affirmances of felony convictions and playing a key role in conviction integrity work.

Eric seeks opportunities to advance public-interest initiatives, including via pro bono work. He represented a leading civil rights organization as amicus curiae in support of a petition for certiorari, which resulted in a unanimous summary reversal by the U.S. Supreme Court regarding qualified immunity in an excessive-force case. He also served as principal author of an amicus brief for a national prosecutorial organization, presenting distinct arguments later endorsed by the U.S. Supreme Court in upholding laws disarming domestic abusers subject to judicial restraining orders.

Early in his career, Eric clerked for the Honorable Raymond J. Dearie of the U.S. District Court for the Eastern District of New York and the Honorable Reena Raggi of the U.S. Court of Appeals for the Second Circuit.
