Eric Del Pozo is an appellate and complex-disputes lawyer who represents businesses, public entities, and other clients in high-stakes litigation and administrative proceedings. Clients turn to Eric for significant appeals, disputes involving government agencies and regulated industries, and matters presenting novel questions of statutory, regulatory, constitutional, or contractual interpretation or application. He also has substantial experience in bankruptcy, insolvency, and restructuring litigation.
Eric handles matters from their earliest stages through appeal. He quickly identifies the claims, defenses, and practical considerations most likely to determine the outcome, then develops an effective record and strategy around them. Whether preparing agency submissions, judicial pleadings, evidentiary presentations, or appellate briefs, Eric positions matters for success at each stage.
Before reentering private practice, Eric served for six years as an Assistant Solicitor General in the New York State Attorney General’s Office, where he litigated appeals and counseled enforcement teams in matters of nationwide interest. There, he received the annual Louis J. Lefkowitz Award for outstanding performance. Eric also spent several years with the Manhattan District Attorney’s Office, handling appeals arising from major felony trials and undertaking conviction integrity work.
In all, Eric has argued more than 50 appeals in federal and state courts and has briefed more than 100 appeals. His cases have addressed precedential legal questions involving insurer insolvency, healthcare reimbursement, federal jurisdiction and preemption, agency authority and deference, business and consumer fraud, tort duties of care, bankruptcy eligibility and remedies, class action standards, tribal sovereignty, coastal management, free speech, religious exercise, search and seizure, due process, and defamation per se.
Eric also maintains an active public-interest and pro bono practice. He represented a leading civil-rights organization as amicus curiae in support of a petition for certiorari, which prompted a unanimous summary reversal by the U.S. Supreme Court in an excessive-force case. More recently, he authored an amicus brief for a national prosecutorial organization, raising distinct arguments that the U.S. Supreme Court endorsed in upholding laws disarming domestic abusers subject to judicial restraining orders.
Eric clerked for the Honorable Raymond J. Dearie of the U.S. District Court for the Eastern District of New York and the Honorable Reena Raggi of the U.S. Court of Appeals for the Second Circuit.
