Kate Dion Examines Legal Questions Surrounding NCAA Eligibility Changes

Education industry team chair and Professional + Collegiate Sports industry team member Kathleen E. Dion shared insights on the rapidly evolving legal framework governing college athletics in the article, "A series of court rulings turned college football upside down. What's next?" published by USA Today on August 26, 2026. The article examines the legal and practical implications of recent court decisions and NCAA policy changes that have created uncertainty around athlete eligibility, including the possibility of former college football players returning from NFL training camps to compete in college athletics. Addressing the growing tension between NCAA oversight and conference-level governance, Kate noted that recent court rulings may not necessarily invalidate rules adopted independently by athletic conferences. "While state-court injunctions against NCAA-wide eligibility restrictions certainly create legal uncertainty, conferences may believe those decisions do not automatically invalidate their own independently adopted rules," she said. "Whether that distinction ultimately holds up will depend on the particular conference, the rule being challenged, and the legal theory at issue." The article explores how ongoing litigation, regulatory changes, and conference responses are reshaping the landscape of college athletics and raising new legal questions about eligibility, governance, and athlete participation. Robinson+Cole Expands Affordable Housing Industry Team with Finance Partner Theresa Omansky

Robinson+Cole announced Theresa A. Omansky joined the firm as a partner in its Real Estate + Development group and Affordable Housing + Finance practice. Based in the firm's New York office, Omansky represents corporations, developers, and institutional lenders in affordable housing transactions, including ownership interest transfers, acquisitions, construction and permanent financings, Fannie Mae and Freddie Mac transactions, and Low-Income Housing Tax Credit (LIHTC) and tax-exempt bond transactions. Omansky joins Robinson+Cole after serving as General Counsel and Corporate Secretary to Housing Partnership Development Corporation (HPDC) and its affiliated entities, where she helped advance the organization's affordable housing pipeline in partnership with public and private entities, government agencies, and community stakeholders, while advising on corporate governance, compliance, asset management, and organizational matters. Prior to her in-house leadership role, she served as Associate Counsel at the Federal Home Loan Bank of New York, where she advised on affordable housing programs, banking and insurance regulations, and arbitration and data privacy policies. Before moving in-house, she represented institutional lenders in acquisition, construction, and permanent financings involving both affordable and market-rate housing developments. Omansky was also previously an associate at Robinson+Cole, where she advised lenders on commercial real estate finance transactions involving affordable housing developments and government-sponsored financing programs. "Affordable housing remains a critical focus for many of our clients and communities,” said Debbie J. Gezon, co-chair of Robinson+Cole’s Affordable Housing + Finance practice. “Theresa's extensive experience with a wide range of financing sources for affordable housing projects will further strengthen our ability to support lender clients and her experience representing developers and affordable housing organizations further strengthens our ability to support clients throughout the full lifecycle of an affordable housing project, from acquisition and financing through development, operation, and preservation. Her return enhances the integrated perspective of our Affordable Housing industry team and our ability to help clients navigate complex transactions and advance projects that meet critical community needs." Drawing on her experience as General Counsel for a mission-driven affordable housing organization, Omansky understands the practical challenges developers, lenders, government agencies, and community stakeholders face throughout the affordable housing development and financing lifecycle. Her in-house and private practice experience provides valuable insight into the legal, financial, operational, and compliance issues that arise in complex affordable housing transactions. "I am excited to return to Robinson+Cole and rejoin many former colleagues while helping clients turn ambitious affordable housing goals into successful, sustainable communities," said Omansky. "The firm's commitment to providing sophisticated and practical real estate and finance counsel, combined with its collaborative culture and strong platform, creates an exceptional environment to serve clients across the affordable housing industry." Omansky's arrival builds on Robinson+Cole's continued investment in its Affordable Housing industry team, which also includes the addition of associate Kaleigh Kenny in New York, as well as Lachanee K. Scott and Stephanos Karavas, whose practices further complement the team's work on affordable housing, community development, financing, and development projects. Last fall, the firm expanded its capabilities with the addition of a ten-member public finance team in New York and Washington, DC, enhancing its ability to advise clients on complex affordable housing, community development, and public finance transactions.
