Gregory J. Bennici regularly litigates disputes related to group and individual welfare benefits, ERISA, managed care contracts, health insurance, disability insurance, and life insurance coverage. Greg also maintains a substantial business litigation practice, representing a variety of stakeholders in complex commercial disputes.

Employee and Group Benefits Litigation

Greg handles disputes related to group welfare benefits, the Employee Retirement Income Security Act (ERISA), health insurance, disability insurance, and life insurance coverage. He regularly defends claims brought against plan fiduciaries, and represents plan administrators and insurers in enforcing plan and policy terms and recovering plan assets. Greg is a contributor to the Employee Benefits and Compensation Group’s ERISA Claim Defense Blog, a platform that offers commentary and insight on administration and evaluation and litigation of group benefits claims as well as other compliance and litigation issues involving ERISA.

Complex Business Litigation

Greg has substantial experience effectively representing clients involved in complex commercial litigations before trial courts at the federal and state level, and in arbitrations and alternative dispute resolution proceedings. Greg has been recognized as “One to Watch” by The Best Lawyers in America®.

Successfully defended arbitration commenced by in-network hospital seeking $73,000,000 on 50,000-plus claims. Served as lead trial counsel in six-day arbitration involving expert topics such as medical necessity, sampling methodology, statistical analysis, medical claim coding, and revenue cycle management. Hearing resulted in a highly favorable award, allowing significantly less than 1% of original claim.

Managed Care + ERISA Litigation: Dismissal of Lawsuit for Empire Plan Benefits by Non-Participating Provider

Obtained dismissal with prejudice of 15-count action by non-participating provider seeking $566,000 plus punitive damages and fees for alleged non-payments and underpayments of out-of-network benefits under the New York State Empire Plan, securing ruling that claims for Empire Plan benefits by non-participating providers “are invalidated by the Empire Plan’s anti-assignment provision” and that the Empire Plan’s administrator does not waive the right to assert that a non-participating provider lacks standing to assert a claim for benefits by not raising the Plan’s anti-assignment provision at the time of the benefit denial.

Life + Disability Litigation: “Full and Fair” Review of Claim for Waiver of Life Insurance Premium Benefits Does Not Require Vocational Analysis

Obtained judgment and affirmance on appeal on matter of first impression that claim administrator is not required to obtain a vocational analysis under Demirovic v. Building Service 32 B-J Pension Fund, 467 F.3d 208 (2d Cir. 2006), when performing a “full and fair review” of a claim for life insurance waiver of premium benefits.
