A former federal prosecutor, Seth B. Orkand brings an insider's perspective to defending clients in their most consequential legal battles. Seth focuses on healthcare enforcement matters, white-collar criminal defense, federal and state investigations brought under the False Claims Act (FCA), and government and corporate internal investigations. He serves as co-chair of Robinson+Cole's Government Enforcement and White-Collar Defense and Healthcare Enforcement teams and is a member of the firm's Business Litigation group and Internal Investigations and Corporate Compliance team.
Health Care Enforcement, Government Investigations + White-Collar Criminal Defense
Clients nationwide rely on Seth's experience as a former federal prosecutor with extensive criminal and civil experience to guide them through government investigations. Seth represents health care entities and their executives in government investigations and complex civil and criminal cases involving alleged health care fraud, including alleged violations of the Anti-Kickback Statute (AKS), the Eliminating Kickbacks in Recovery Act (EKRA), the False Claims Act (FCA) and the Stark Law. He has extensive experience conducting internal investigations and assisting clients to respond to investigations by CMS, HHS-OIG, DOJ, and other regulatory and enforcement agencies. Seth’s clients span the healthcare industry: clinical laboratories; medical device manufacturers; wound care distributors; remote patient monitoring providers; durable medical equipment suppliers; and hospital systems. He also represents clients in the financial services, government contracting, manufacturing, and construction industries in high-stakes government investigations.
An experienced trial lawyer, Seth served as an Assistant United States Attorney for the United States Attorney’s Office in the District of Massachusetts, and as a Special Assistant District Attorney in Massachusetts. Seth uses that experience to litigate civil and criminal cases against and involving the government and/or private relators under the FCA.
Title IX Investigations + Student Discipline Matters
Seth is a highly skilled and compassionate sexual misconduct investigator, advisor, and decision maker. He has successfully represented dozens of students, staff, and faculty members in Title IX hearings and academic integrity investigations. Trained in trauma-informed advocacy and as a Title IX investigator by the Association of Title IX Coordinators (ATIXA), Seth is trusted by colleges, universities, and public and independent K-12 schools to conduct fair, impartial, and prompt investigations of high-profile and sensitive matters.
Pro Bono Service
Seth is chair of Robinson+Cole's Pro Bono Committee, coordinating the firm’s pro bono initiatives, expanding the firm’s network of pro bono clients, and matching Robinson+Cole lawyers with pro bono opportunities. He also serves on the Standing Committee on Pro Bono Legal Services for the Massachusetts Supreme Judicial Court. While in law school, Seth interned with the Office of the Prosecutor at the International Criminal Tribunal for the Former Yugoslavia in the Hague. He has extensive pro bono experience working with juveniles sentenced to life imprisonment to prepare for parole hearings and with survivors of sexual assault. In 2014, the Massachusetts Supreme Judicial Court awarded Seth the John Adams Pro Bono Publico Award in recognition of his service to victims of human trafficking.
