Stephen O. Clancy focuses his practice on insurance coverage and extra-contractual litigation, as well as professional liability and other complex litigation. He is a member of our firm’s Litigation section, and its Insurance + Reinsurance practice group.

Insurance Coverage Litigation + Counseling

Stephen’s insurance coverage experience includes the representation of property, liability and excess insurance carriers in connection with high-exposure litigation often involving claims for extra-contractual damages. In the property insurance arena, he has served as counsel for major commercial property insurers in connection with litigation arising out of damages associated with Chinese Drywall, and natural catastrophes such as Hurricane Irene and Superstorm Sandy. He has also handled cases involving large business interruption and/or ordinance or law exposures. In addition to handling litigation, Stephen also assists his property insurer clients by coordinating investigations and appraisals, providing coverage opinions and analysis, and assisting with responding to inquiries from various state insurance departments. He has also been retained to provide advice regarding the proper organizational structuring of a claims department in order to best avoid imputed conflicts of interest and to protect privileged communications and confidentiality.

Stephen’s liability coverage litigation experience includes the representation of liability and professional liability insurance carriers in connection with high-exposure litigation often involving allegations of bad faith settlement practices. He also provides pre-judgment advice to liability and professional liability insurance carriers in connection with minimizing bad faith failure to settle exposure.

Professional Liability Defense

Stephen’s experience also includes the representation of a diverse group of individual and institutional clients including legal, medical, financial, insurance, and design professionals. He has successfully defended professionals in connection with seven and eight figure malpractice litigation.

Stephen is a regular speaker before legal and industry organizations on various insurance coverage related topics. He is the chair elect of the American Bar Association TIPS Property Insurance Law Committee and a member of the Steering Committee of the Hartford Chapter of the Professional Liability Underwriters Society.

Prior to joining Robinson+Cole, Stephen served as a judicial law clerk for the Honorable Barry R. Schaller of the Connecticut Appellate Court. While at the University of Connecticut, he represented indigent clients as a member of the school's criminal appellate and trial clinics, and he also served on the editorial board of the Connecticut Law Review.

Experience


Underpayment Following Fire

Achieved positive resolution of multiple claims against insurers for alleged underpayment to policyholders following a fire at a Manhattan condominium building.

Damages Sought in Arson Case

Obtained summary judgment in favor of insurer in case which sought contractual and extra-contractual damages in a case arising out of suspected arson. The Connecticut Appellate Court affirmed the summary judgment ruling.

Insurance Policy Breach

Successful in obtaining summary judgment for insurer in litigation which alleged it breached its insurance policy by refusing to defend and indemnify an insured in connection with an underlying lawsuit, which claimed the insured created a barrier to obstruct neighbors’ water views. The Maryland Court of Appeals affirmed the summary judgment ruling.

Stephen Clancy Elected a Fellow of the American College of Coverage Counsel

Insurance + Reinsurance group partner Stephen Clancy was elected a Fellow of the American College of Coverage Counsel (ACCC). Stephen’s election distinguishes his skill, experience, and high standards of professional and ethical conduct in the areas of insurance coverage and extracontractual law. Established in 2012, the ACCC is an invitation-only organization of senior lawyers who have devoted most of their practice to insurance disputes for 15 years or more. The ACCC’s Fellows include many of the most prominent members of the insurance law bars of the United States and Canada, as well as Honorary Fellows from academia and the judiciary. The ACCC’s mission is to advance the creative, ethical, and efficient resolution of insurance coverage and extracontractual disputes; to enhance the civility and quality of the practice of insurance law; to provide peer-reviewed scholarship; and to improve the relationships among the members of our profession. In addition, the organization focuses on educating all sectors involved in insurance law—including the judiciary, legal and insurance professionals, law students, and businesses—on cutting edge, emerging, and critical issues such as developing trends in insurance law and bad faith, trial practice and alternative dispute resolution, policy formation and claims handling.
