Evan M. Lazerowitz's practice focuses on Chapter 11 bankruptcy cases, with an emphasis on the technology, mass tort, life sciences, healthcare, and retail sectors. His practice has included representations of creditors’ committees, debtors, distressed asset purchasers, landlords, individual creditors, and secured lenders in Chapter 11 cases. Evan has experience representing creditor committees in complex bankruptcy cases including in SWC Industries, Mallinckrodt, Endo Pharmaceuticals, JCPenney, Lord & Taylor, LTL Management (J&J), Avon Products, and Whittaker, Clark & Daniels. He has recently represented creditors in the Chapter 11 cases of Big Lots, Marelli Automotive, and Powin Energy. 

Evan also has significant experience handling bankruptcy appeals, investigating and pursuing fraudulent transfers, and other causes of action for the benefit of bankruptcy estates, and litigating cutting-edge intellectual property issues that arise in distressed situations. He also has co-authored a Chambers guide to insolvency regarding trends and developments in Delaware bankruptcy law, and the Norton Annual Survey of Bankruptcy Law article on intellectual property and technology issues in distressed situations.

Evan recently served as counsel to the Official Committee of Unsecured Creditors in the landmark bankruptcy of Mosaic Companies, a luxury wall and tile company. The case addressed silica liability and resulted in a consensual plan of reorganization, including the creation of separate trusts for silica and general unsecured claimants. Evan played a key role in negotiating the novel terms of the bankruptcy plan and global case settlement.  

Before joining our firm, Evan served as a special counsel in the New York office of a law firm and primarily focused on representing innovative technology companies and counseling public and private high-growth companies. Other roles include commercial litigation associate at an East Coast-based law firm, and law clerk to Judge Mitchel E. Ostrer in the Appellate Division of the Superior Court of New Jersey.

Bankruptcy + Reorganizations Group Guides Food52 Through Successful Chapter 11 Case

Robinson+Cole's Bankruptcy + Reorganizations group represented the Official Committee of Unsecured Creditors in the Chapter 11 case of Food52, a digital platform and lifestyle brand dedicated to cooking, entertaining headquartered in Brooklyn, NY. Food52 and its affiliates filed for bankruptcy due to mounting debt, unsustainable post-COVID operational costs, and a liquidity crisis triggered when its primary lender unexpectedly swept the company's accounts. Through intensive negotiations and a comprehensive investigation, the Robinson+Cole team helped secure: A revised debtor-in-possession facility ensuring financial stability during the restructuring process. The successful sale of the company’s primary operating businesses through an auction that resulted in a 90% increase in value over the opening bid. Negotiation of a global settlement among the Committee, the Debtor’s equity holder, and certain former officers, resulting in significant reductions to the claims pool, and leading to the confirmation of a consensual plan of reorganization, which resulted in the creation of a liquidation trust tasked with marshalling assets and making distributions to unsecured creditors. The purpose of the bankruptcy, for creditors, was to maximize the sale price of three affiliate subsidiaries for their benefit and to otherwise safeguard their rights. Estimated deal value: $10–$50 million. The matter was led by Rachel Jaffe Mauceri, Jamie Edmonson, and Evan Lazerowitz, with support from Andrew DePeau, Annecca Smith, and Amanda Donato. This case underscores Robinson+Cole’s commitment to innovative solutions in complex restructuring and retail cases.
