Ryan D. Hoyler is a land use lawyer and litigator. His legal experience includes representing developers before municipal Planning and Zoning, Wetlands, Water Pollution Control Authority, and Historic District boards and commissions across Connecticut on a broad range of approvals and permits. Ryan also represents landowners, developers, and municipal agencies in courts across Connecticut, both on appeal from zoning applications and in other legal disputes. 

Ryan works on land use disputes over easement rights, sewer usage, lease agreements, nonconforming uses, and development rights, among other issues. He also assists in preparing due diligence reviews of brownfield sites across the country. Ryan has conducted environmental due diligence for roof-top solar developers throughout New England and assisted local counsel in preparing waste disposal agreements and permitting applications for a highway reconstruction project in New York. He also represented a major environmental conservation organization in Connecticut in preparing agreements with various land trusts to allocate federal funds for the preservation of environmentally-sensitive lands and prepare restrictive easements for those lands. Ryan represents a local homeless shelter and community group in land use approval applications to town Commissions and on appeal.

Ryan started his career in California, where he represented a developer attempting to build convenience stores before both county land use boards and in state Superior Court on appeals from California Environmental Quality Act determinations of significant environmental impact. He also worked on antitrust litigation in state Superior Court on behalf of a large liquor distributor and drafted various briefs in administrative appeals relating to large underground storage tanks in Hawaii.

Legal Update: New Laws to Promote Affordable Housing Development

California Appellate Court Holds Annual Permits Allowing Short-Term Rentals Do Not Provide Vested Rights, But Communities Must Justify Exempting Residents from Short-Term Rental Prohibition Under Dormant Commerce Clause

In the article, Ryan details a California Court of Appeals ruling that held that there was no violation of vested property rights for short-term rentals operating under annual permits issued by the City of South Lake Tahoe. The City of South Lake Tahoe’s short-term rental regulations were amended in 2018 by popular vote to not permit any vacation home rental within any residential zone, with minor exemptions. An association of owners and managers of vacation rental homes sued the city over the amended regulations. The court initially dismissed the plaintiffs’ case on summary judgement with an appellate court subsequently upholding ruling. However, Ryan highlights that while the court upheld the ruling there were measures that facially violated the dormant commerce clause because the regulations permitted residents to engage in short-term rentals for a period of time while prohibiting non-residents from the same. The case is back in trial court to brief the dormant commerce issues more fully. View the article.

Recreational Marijuana in the Land of Steady Habits: How Towns in Connecticut are Zoning for Recreational Cannabis Use

Connecticut Planning, a quarterly magazine issued by the Connecticut Chapter of the American Planning Association (CCAPA)

The legislation that legalized cannabis use in Connecticut “…also empowered the state’s municipalities to regulate adult recreational cannabis establishments through local zoning codes or ordinances.” The authors surveyed the state’s 169 municipalities to identify regulatory trends and varying approaches taken by communities across the state. There are at least 90 municipalities that permit some form of cannabis establishments, with 72 of them having enacted their own regulations. Evan, Ryan and Chris examine and report how municipalities are dealing with related issues including where establishments are allowed, permitting and procedural considerations, distance separation requirements, security and odor issues, and visibility of products. Evan serves as CCAPA’s Program Committee Chair and is a member of the Executive Board. View the article.
