Artificial Intelligence’s Transformative Impact on the Construction Industry

National Organization of Minority Architects Connecticut Chapter’s (NOMAct) Intersections

Larry offers insights from the Group’s annual Construction Industry Roundtable where the opportunities and challenges of integrating artificial intelligence (AI) in the construction industry were explored and discussed. The article highlights how AI can reshape how construction professionals operate, specifically in architectural design, safety protocols, and project management—he also discusses the hurdles remaining for widespread AI adoption. “AI-powered tools can lay out floor plans when provided with basic dimensions…allowing architects and designers to produce lifelike representations of buildings with minimal input,” writes Larry. “These innovations accelerate the design process and minimize errors that could lead to costly rework.” When discussing how AI is impacting project management, Larry emphasizes how “converting design files into actionable written requests for contractors, enable[es] smoother workflow” and “reduc[ing] the workload for legal and administrative teams, allow[s] them to focus on other [important] tasks.” Concerning safety, Larry mentions how “AI-powered drones and robots can identify hazards, monitor job completion rates, and collect valuable data for decision making.” However, Larry cautions that “the construction industry remains hesitant to embrace AI,” citing concerns that over-relying on technology will lead to a lapse of critical judgment, explicitly highlighting the Hartford Civic Center’s roof collapse as an example of “flawed software recommendations.” To read the article in full, click here (page 7).

Worker Classification Continues as ‘Hot Topic’ for 2024

In the article, Abby and Jessica discuss the Department of Labor’s final rule revising previous guidance on employee and independent contractor status under the Fair Labor Standards Act and the criticality of properly classifying workers. “Misclassification poses serious risks to employers as it may deny workers proper protections and benefits and results in fines, penalties, payments, and other liability,” they write. “It is important for employers to understand the relevant test(s), their application, and the risks associated with misclassification as this area has been and continues to be a focus of enforcement.” Read the full article.

Massachusetts Construction Industry Continues To Wait While Prompt Payment Law Is Put To The Test

Earlier this month, the Massachusetts Supreme Judicial Court (SJC) heard argument in J.C. Cannistraro, LLC v. Columbia Construction Co. et al., a dispute concerning the state’s Prompt Payment Act (PPA). Although a decision has yet to be issued, it could potentially pose widespread implications for high-value private construction projects moving forward – and perhaps backwards....

CA Civil Code § 8850: What Private Multi-state Owners and Developers Building in California in 2026 Need to Know

Owners and developers building in California must be aware of a new statute, CA Civil Code § 8850, which takes effect for contracts entered into, on, and after January 1, 2026. The statute will likely apply to most private construction projects; however, a carve-out exists for residential projects that are not mixed use and are...

Fixed Price, Fluid Quantities: The Hidden Risks in Lump Sum Agreements with Variable Units

Lump sum construction agreements are the most basic of the different design-bid-build options: the contractor agrees to complete the entire scope of work for a fixed price, and assumes most of the quantity and cost risks. If the contractor’s actual costs exceed its estimates, the contractor absorbs the loss. Adding a clause into the construction...

Beyond the political finger-pointing and investigation into the pause’s impact (the billions of dollars already appropriated remain untouched) is...

The Importance of Indemnification Clauses in Managing Post-Completion Project Risk

Claims against design professionals often pose unique challenges when such claims are dually rooted in both tort and contract theories, and therefore subject to competing time limitations. To reconcile these differences, Massachusetts courts have historically looked to the “gist” of a given claim, rather than the label, to assess the appropriate limitations. A determination that...
