Affordable Housing + Finance team member Kristin Niver presented a program titled, “After OBBBA, the tax credit drives the deal—the debt follows,” as part of myLawCLE’s webinar series. Kristin’s program focused on how the One Big Beautiful Bill Act (OBBA) has accelerated timelines for Section 48E credits and introduced new foreign sourcing restrictions, making early planning critical for affordable housing solar projects. In addition, she examined how tax credit monetization strategies, including tax equity, credit transfers, and elective pay now play a central role in shaping financing structures alongside existing LIHTC, HUD, and agency requirements; highlighted new compliance obligations such as prevailing wage, apprenticeship, BABA, Davis-Bacon, and foreign entity rules can significantly affect project economics and financing terms; and provided practical guidance on structuring, underwriting, diligence, collateral, and consent issues for ITC-backed transactions.
