Bankruptcy + Reorganizations Group Leads Successful Confirmation in Alachua Government Services, Inc. Bankruptcy Case

Robinson+Cole’s Bankruptcy + Reorganizations group successfully assisted in obtaining confirmation of a favorable Chapter 11 plan of liquidation for debtor Alachua Government Services, Inc. (AGS) in the Bankruptcy Court for the District of Delaware (Case No. 25-11289). AGS, a pharmaceutical manufacturing and research and development company based in Alachua, Florida.

Robinson+Cole represented the Official Committee of Unsecured Claimants, fostering the negotiation of a complex global settlement with other affiliates for the benefit of general unsecured creditors.

Among other terms, the settlement includes the establishment of a Liquidation Trust; a $3 million contribution to the Debtor’s corporate parent; the subordination of certain intercompany claims; payment of disputed severance claims; and NRI’s satisfaction of certain legal fees incurred in connection with intellectual property defense matters. In addition, Robinson+Cole helped secure the consensual resolution of objections to confirmation filed by the Department of Defense, which held a claim exceeding $120 million. The plan incorporating these resolutions and settlement terms was approved by the Bankruptcy Court on July 21, 2026.

The matter was led by partners Natalie Ramsey, Benjamin Daniels, and Rachel Jaffe Mauceri; counsel Evan Lazerowitz, Laurie Krepto, and Elizabeth Leong; and associate Richard Willi.

For the NCAA, the ruling raises questions about the extent to which courts may review and potentially limit the enforcement of eligibility and competitive-integrity rules in individual cases.”  She continued, “It is also important to recognize that this is one state trial court decision, not a final decision on the merits, and thus its precedential value may be limited. While the court found that Sorsby demonstrated a probable right to the relief that he seeks on his breach of contract and other claims, which is a necessary element for obtaining a temporary injunction — the order does not appear to provide a detailed explanation of the court’s reasoning on that issue. As a result, many of the legal questions raised by the case are likely to remain the subject of further litigation and possible appellate review.” Discussing the foundation of the claim, Natale said, “The underlying dispute looks like a claim that the NCAA failed to accommodate a disability (e.g. an ADA claim based on a gambling addiction).
